Barngarla Determination Aboriginal Corporation RNTBC

The Barngarla Determination Aboriginal Corporation RNTBC act as an agentt for the benefit of the Barngarla Traditional Owners.

Originally, there was an application in 2012 regarding the determination area. This application was split, allowing the Port Augusta Town Area, which was subject to overlapping claims, to be dealt with separately from the remainder of the application. Following that, all parties to the proceeding reached an agreement to the terms of a determination, excluding the area of the Port Augusta Town Area. On 23 June 2016, Mansfield J made orders recognising the native title rights and interests of the Barngarla native title claim group in accordance with that agreement. 

At the time of the initial judgment, the parties acknowledge their intention to enter into an Indigenous Land Use Agreement (ILUA) to resolve extinguishment issues. 

In 2018, the Barngarla Determination Aboriginal Corporation RNTBC entered into the Barngarla Determination Indigenous Land Use Agreement, consenting to the surrender of their native title over portions of land in the agreement area to the State. 

On 24 September 2021, Charlesworth J made a positive determination of native in relation to an area of land of about 80 square kilometres, incorporating a large part of the regional city of Port Augusta in South Australia and extending into the waters of the Spencer Gulf.
