The Birriah Aboriginal Corporation RNTBC holds native title in trust for the native title holders.

The Birriah People first lodged a native title determination application on 2 April 1998. Following various amendments of their application, on February 2015, the proceeding was divided into parts: Birriah Part A and Birriah Part B.

On 23 March 2016, Logan J made a positive native title determination in relation to the Birriah Part A. On 29 November 2016, Reeves J made a positive native title determination in relation to Birriah Part B.

For both Birriah Part A and B, the native title holders have, other in relation to water, the right to possession, occupation, use and enjoyment of the area to the exclusion of all others.

The Birriah Aboriginal Corporation RNTBC entered into an ILUA with various other parties, including Iron Road Limited. The two parts of the agreement area cover approximately 145.7 square kilometres. One part is outside Wudinna and other extends from Warramboo to southwest of Port Neill. The purpose of the agreement is to provide consent to mining activities in the native title claim area.
