The Miriuwung and Gajerrong #1 (Native Title Prescribed Body Corporate) Aboriginal Corporation, located in Kununurra, administers land on behalf of the Miriuwung-Gajerrong people. Their ownership was recognised in the Miriuwung-Gajerrong (Western Australia Area 2) determination of December 2003.
This determination is one in a series of claims that was negotiated and later litigated through the Federal and High Court, culminating in the Ward decision by the High Court.
This part of the claim was negotiated. It included the Ord River Irrigation Area, Lake Argyle, Lake Kununurra, the Glen Hill pastoral lease, mining tenements, part of the Argyle diamond mine and the Keep River national park. All parties agreed to recognise Miriuwung Gajerrong people’s native title rights to possession, use, occupation and enjoyment of the claim area. In some places these native title rights enable the traditional owners to exclude others from exercising similar rights.
This agreement was affirmed by the Federal Court in the Miriuwung-Gajerrong (Western Australia Area 2) determination of December 2003.
